Hi All,
We have applied for 485 in July 2007(SELF+SPOUSE+KID). Bcoz of the issue with Fee, my son's 485 packet was sent back. Meanwhile, me and my spouse got our FP notices and we did them at nearest ASC.
My Lawyer corrected the fee and sent my son's 485 back to USCIS and was accepted. I got his reciept numbers in Dec 1st week. My son is 16 months old and we did not recieve his FP notices yet.
Do we receieve FP notices irrespective of the age or do we have any relaxation of kids under a certain age..Any one has any experiance..please share..Appreciate it..

My Wife had the same issue when her H1B got approved. Her attorney (It was his mistake) had to amend the petition . But I remember we got a new receipt number and a new I-94 with the corrected DOB when the final approval came. The bad thing is the amendement application also enters the H1-B cycle of months for approval if not filed under premium processing. We had plans to travel back to India and do stamping at that time. I had to pay this attorney $1000 for PP even though it was his mistake.

I-140 belongs to the employer only, so it is up-to them to disclose the details. Unless you change employer without using AC21 clause, I-140 details won't be necessary.

Just to be contrarian, I think the recent H1-B and L-1 fee increase is an opportunity. Instead of playing a victim of legislative abuse, we should come out batting with an offense. We should get businesses to lobby for us. We should get congress people educated about the unfairness. We should not say the fee is wrong, because these are after all elected officials and they will not jeopardize their election prospects by going against this measure. So we should say ok take this fee but then provide us with administrative fixes that we want.

Yes but I was thinking, spouse and children are counted in family based visas and how exempting them will benefit EB visas. Correct me if I'm wrong. :confused:
At present the dependents are counted in the EB cap...So the number 140K for EB is principal applicant+dependents combined...This bill exclude all dependents of EB from any cap...(But the country limits still apply I guess)...
FB and EB cap got nothing to do with each other..

I'm going to Vancouver for H1B stamping next week along with my spouse. My understanding is that $150 is the application fee but I'm not sure if it is $150 for entire application (H1 + H4) or is it $300 ($150 for myself and $150 for my wife).

Yes he can , but once 180 days of pending "I-485" are passed then you are free and protected by AC21.

I applied for 485 in July as a future employee for X using that approved I-140. I got EAD and AP also.
Now we got into some money issues and he wants to revoke my I-140/I485?
Can he do that?
Please advice.
