My PD is Jan04 in eb3 catogory and I am from India. Currently I am working under EAD . My wife recently got job offer and her company is ready to file her labor under EB2 category. My question is thats ? will that be a problem when she files for 485 based on her labor since she already filed 485 based on my labor . Any suggestion is appriciated .

Hello,
I have recently moved from Company A(where I worked for 6 years of which last 4 years was in US on H1B) to Company B(working here for 6 months). My H1B transfer is complete but my VISA needs stamping. I need to travel to UK for 2-3 days next week.
Am I eligible to get the Visa stamping done in London? If so, is this a high risk option? How do you compare the risk of the option with the risk of alternate in making a trip to India from UK to get my Visa stamped? Does the fact that my current job is with a smaller(200 to 500 employees) IT consulting firm add to the risk significantly?
Do you think it is possible to get stamping dates around Dec 12-13?
In case VISA gets rejected in UK, what are the chances I can go back to India and get it stamped after that? And how long will that take on average?

I just joined a new company and would like to use AC21 as I will be working on EAD. 140 is approved and 485 is pending for more than 180 days. New job is same or similar as per ONET job code.
My question is,
Is it necessary to involve your attorney or you can simply go ahead and file AC21 yourself?
I would like to what others have done? What kind of extra fees your attorney has charged for AC21?

If you really don't want to use the DataGrid, you could just use a ListBox. Each ListBoxItem (you can edit the ItemsTemplate) could be a textbox with a series of comboboxes inside it. That will give your users the illusion of having a scrolling list of items that they can enter values into.

If you haven't filed I-485 yet, you cannot use AC21 as it requires I-485 to be pending for more than 180 days. It means, that you're stuck with your ex-employer for GC processing unless your new employer is willing to file new LC and I-140 for you. You can port the PD of your approved I-140 to the new one.
Once your PD becomes current, then you can file I-485.
I think you got my question differently. My ex-employer is A where I had my I140 approved . Now I am with employer B. If i want to continue with B then I have to file LC+140 with old PD but if I go back to A in same role then I have to file only 485 but my LCA is specific to location in CA .My question is wether I join A in NY and still file AOS based on old PD or not.

this makes it very hard for people who jumped jobs in their 7th/8th years with 1 year extensions from new employer. All were hoping to get LC+I_140 done within that year so they are eligible for further H1B extensions.

Just returned from traveling abroad. I am hoping my PERM approval from atlanta comes through somehow in time for me to be eligible to apply for I485/140....I am supposed to travel again out of country on Aug 17 to end of august (this is all to help me recoup/extend my h1b for 365 days of LC pending to be eligible for H1B extension)...i know traveling right after filing I485 is questionable..my lawyer (i think i trust him) says it's ok.
My question is regarding the I-94 card. I have the 3 yr extension approval on my original H1B that I carry every time I travel. I was told this is most important doc as it has my number or something to track my travel.
Usually when I am coming back, the INS officer will check it and cross of the already printed I-94 number and copy another number from my approval/extension notice on to it....usually...i think this is done.
This time when I returned yesterday, the INS officer did not do that. I know she looked at my visa stamp in passport that has same numbers and she updated her comp/system whatever, but no number change on the actual I-94 card was noted. So it has the original printed I-94 number.
My question..is this a problem. I gently tried asking her if she needed to note/change number on my I-94 and she rudely said "no". So i shushed up not knowing much about this. She didn't even look at it saying once I have stamp, I have no need for that approval notice...i was told otherwise before by another INS officer when traveling while back.
Also when I do travel on Aug 17, and hand in that I-94 card...how will they track that it's ME leaving since it has none of my H1B approval number on it. I need them to know I left the country so I can recoup the time...

You are eligible for 1yr extensions. If your I-140 is approved, you can get 3 yr extensions. Since you are saying it is NIW, it is always better to be on H1 because those cases are approved after intense scrutiny. Where was your I140 application sent?

Funny you post this, I actually had a conversation this morning stating that I have digicam lust for the first time. Wow that puppy looks nice. Guess I always wanted a lieca ;)
While we are talking about digicams, maybe we should make a digicam forum as a resource for others? just a possibility.
