You have to be "in-status" to apply for AOS. The IO wants evidence of your continued non-immigrant status before you filed your AOS. Also, remember AOS does not grant you a status. It just lets you not accrue unlawful presence

hello all..
im currently living in NJ and my i-140 was approved.. since im on EB3 and my priority date is on 4/2008 i still have some time to wait in order for a visa to be eligible to me..
my main concern is : i would like to know if its possible for me to obtain a driver license with the approval notice i received from USCIS (i -797c Notice of action).. does my employer will need to fill out any forms for for that to happen ?? if so, what kind of forms :(
any help is appreciated..

I assume that your I-485 is not yet filed. If it is true, you must be having a H1-B or other work visa to maintain your work status. If yes, those are the documents you will need to get Drivers License extensions.
To my knowledge, approved I-140 is not an immigration status that can enable you to get a Drivers License extended on its own.

Friend of mine, asked me the below question, any one can Help?
I got my H1-B visa stamped in the month of Feb 2007 from US consulate in chennai. I have not yet travelled on that visa, so I am wondering whether the same visa is still valid, as someone told me that if you don't travel on a visa for 6 months after stamping, it gets expired.

I have a question. Our files are stuck in the Chicago local office (after our interview last year) and the only thing pending is the Namecheck, which has been pending for more than 180 days. Our PD is current. Is anyone in the same position?
It is frustrating because you do not get any LUDs when your files are in the local office and I have no indication whether the Chicago officeis processing cases with NC pending > 180 days. Anyone knows?

I received card production e-mail today.
My PD June 2007, RD Oct 2007. No REFEs. EB1 India.
Thanks for all the help and good counsel.
Lesson from this experience: Learn to handle delays. Take things in your stride. Do not make GC as end of your life. We can work anywhere and be happy, though US is a preferred destination.
In this process, I made so many friends and learned to heed others views and good advice.
Will continue to work for IV.

I've been noticing for some time now no matter what I have my white balance set on that every time I upload my pictures to my gallery it always reads "cloudy" in my EXIF data. Has anyone else noticed this type of discrepancy with thier photos?

Make sure you do not travel out of USA before you get your approved AP, since as per the law if the person who filled I485 leaves the country without AP then it is considered that he abandoned his I485, with the exception given to H1B/H4 and L1/L2 (and youdont have any of these)
If you leave USA without AP then you need to restart the process, if you have AP then that is all you need to travel.

its good to use your OPT card as long as its vaild and then move to H1, there is no time frame for stamping, its always good to go to your home country and then get it stamped,but once you start working on H1(your payrolls starts on H1) then your H1 clock starts

Is AC21 relevant at all for NIW applicants? It can not be as there are no employers filing for such people. However is there anything related to that for such applicants?
Can't they change job or use EAD for whatever job they want to take?
Should the new job be exactly the same type of job?
If an NIW applicant loses job, will that be a problem?
When USCIS is going to know/check on what job the applicant is currently working? Is this going to happen at the I-140 approval stage or I-485 stage or when somebody applies for Citizenship?

I am on h1b visa in my 6th year. My previous employer had applied for my GC under EB3. My I-140 was approved from old employer with the PD of october 2007.Now, my new employer is going to file the GC under EB2 but the lawyer is not sure if the I-140 would be approved (since its EB2). My question is:
If the new I-140 gets denied due to any reason, will my old I-140 still be valid (under EB3). The old I-140 has not been revoked or withdrawn. My new employer has applied for my h1b extension (beyond 6th year) on the basis of my previous approved I-140. pls do reply. thanks.

Better wait for your receipt numbers from I-797. I think this case is for somebody else and it is about appeal from decision of previously adjudicated case.

USCIS has been "pre-adjudicating" I-485's without current priority dates so that they can be approved expeditiously once priority dates become current. This is likely a waste of effort given that it may be years before many EB-3 priority dates are reached.

How long does it take these days to process greencard in L1 Category these days. If the sponsor company applies L1 visa for a very experience worker, what is the best type of L1 visa needs to be applied that will lead to a quicker greencard status.
