I guess Berkeleybee was talking about me....I posted a few theories in another thread regarding PACE act.
I certainly understand the IV has done a lot and am very excited about what you have achieved. Not sure how you view it, but I think posting my view in the forum is also a form of support. It may not be as much as you wanted, but nevertheless it by no mean is saying what you did was wrong, it's just some thing I thought about and I thought it might be worth to bring up. But If this bothers you then I have no problem to shut up.
Not sure why IV chose to lock up live update threading to member only though. Growing number of members is definitely good, but I am not sure about forcing people to register to read. People participant when there is a passion in it, forcing they into it more or less drive the passion away.

I have contributed 600$ along the way because i believe in what IV is trying to acheive. To Berkeleybee, i have recently noticed that you always ask the people directly or indirectly whether they know more than you. While It may be true that you guys know more than us, because u spend hours upon hours making it your business to know, but that does not mean you would want to curb free speech. We are grateful to each and every IV core member for their extrodinary efforts, but do not admonish us because somebody wishes to express their ideas. Who knows if people propose 100 theories there might be 1 out there that even you guys have not thought about.
Personally if i were a member of the core team, i would not even bother to respond back to the threads where the so called theory holds no water. There are enough people in this forum to speculate for you :-).

All,
Did not want to create any sensational news, but this is what I gathered from speaking to an IO. I had applied for my EAD on Jan 25th and havent received any updates. So, I called the NSC customer service and an IO informed me that I need to check back with them in another 60 days if no decision is made by that time. When I said that it would be 6 months by that time, the IO said that "that's right. Each IO has about 500 applications on their desk and it will take some time to clear these off"
Just wanted to update everyone so that all the June/July filers can file appropriately.
Again, mine could be an isolated case. So, please dont panic::))

You can only get a US visa outside of USA and you only need a visa to enter US since you already in US then why do you need a visa? when you go back just apply for another B1 Visa

The reason we want to maintain is to get the spouse to USA on H4. I am not sure if there is other ways of bringing the spouse to USA while on EAD/AOS

What do you mean by AP and EAD delayed? Once you have applied for your 485 and all things considered OK, you should get your AP and EAD. If dates retrogress again, you will have to keep renewing your AP and EAD till you get your GC. How long it will take to get AP and EAD? Right now, I believe it will take a lot longer, maybe upto 6 months given the load of apps. they will receive.
looks like the sooner you submit the package, the better !!! even if I don't harbor any hope to get my GC before mid-2008.

Difficult times also present opportunities. Anyone who can start it, especially in EB2, can really benefit from the timing simply because there are MUCH fewer people going for it these days for different reasons. Wait till everything turns rosy again and you'll find yourself among hundreds of thousands of fellow GC pursuers. Sitting in the huge PD2011 queue while watching PD2008 - 2010 people getting fast approvals won't be fun.
The best time to start GC process is always yesterday. And if scrutiny is the concern, let's face it, there is not a good time for it. It's always worrisome until you get that card.

Hi everyone
My husband (H1B) and I (H4) We live in Chicago and wanted to get H1B visa stamp in Canada. My husband has been on H1B since 2003 and he is NOT in IT field.
Our experience:
Step 1: Put together all the documents and take a appointment date in Ottawa (Toronto had a long wait and we had heard a few horror stories so to be on a safer side)
Step 2: Went to Detroit to get a Canadian Visa. Very straight forward the only question we were askes was "Why are you going to Canada for a visa stamp?" We got our passports the same day. This can be done via post as well!
Step 3: We drove to Ottawa - 15 hours from Chicago. Crossed border in Niagara, NY. It was very cool. Hardly 30 min wait in the queue and 5 min wait at the window. We didn't even got out of car.
Step 4: After spending weekend in Niagara and Toronto reached Ottawa on 22nd Nov for visa appointment on 23rd Nov, 9 am.
Step 5: My husband reached consulate at 8:45 am (We stayed 10 min from the consulate in Quality Inn hotel, Ottawa) He was asked very basic question. Such as:
Which employer?
How long on H1B?
What do you do?
Has immigration petition been filed? (Yes)
Do you have the document for labor? (No I only got H1B relevant documents.. Sorry!)
Why stamping in Canada?
Step 6: He was told that his passport will reach DHL office on either Thurs or Fri (2-3 working days)
Step 7: We came back to Ottawa on Thursday (26th Nov) after spnding one day in Montreal and one day in Quebec city. We straight away went to the DHL office (timing are 8:00 - 18:00 closed Sat, Sun) They had his passport ready even when online the status was saying no info !!
Step 8: Friday - 27th Nov we drove back to US and crossed border at 1000 Island bridge in NY. We had to get out of our car and they issued my husband a new I 94 (nothing for me) because he didn't have a white I -94 he only had a bottom part of his I 797 approval. They charged $6 for I 94. They were very friendly unlike immigration at airport!!
We reached home on Saturday after a fabulous road trip along with a successful visa stamping!!

my lawyer says... apply now.. dont know what will be situ in october.. it might go forward.. backward...my pd is 10/2003.
he says since my medicals are over.. all docs are ready ... so he says file and be part of lawsuit..
is this wise idea...if i say yes.. he will file by next week..
i already sent money for my wife...
my company is not covering my wife's expenses.
the lawyer is charing 600 for legal and 745 for filing...

From what I understand, you guys should apply. Worse case scenario is that it will be sent back, but, if something comes out of the law suit or so called compromise, you guys could just become lucky.
FWIW, a big technology company's lawyer are sending almost 1100 applications.

1. Which documents are required to convert H1 to H4 while being in USA?
2. As per my understanding if I convert to H4, I can use my H1 at a later point of time. Is it true? What are the preconditions for this?
3. What happens to my green card process if I convert to H4? I have my I-140 approved.
4. Assuming that my understanding in point-2 is correct what is the process to convert back to H1?

I had to open a new thread to get your attention to this. But it seems that the House Stimulus Bill passed this evening contains the 'E-Verify' . Incidently, when Sen. Menendez introduced the Visa Recapture Bill last year, he held the republican's at bay by not passing E-verify in the senate. If, E-verify is passed in the senate, then we will loose an important bargaining chip for visa recapture bill of any kind. Please read the info. below. You can also google e-verify house stimulus bill to get the latest.
Action step is to strip e-verify from the Senate Stimulus bill. Please see below.

This will not only delay use of stimulus funds, but will hurt millions of workers. It should be stripped from the bill.
The E-Verify provision in the stimulus will:
� Harm workers who are either falsely denied work or are targeted by employers abusing the E-verify program;
� Create substantial new burdens for businesses, especially small businesses, at precisely the wrong time;
� Send the wrong signal to new voters that the Congress prefers to play politics by enacting symbolic and ineffective immigration �enforcement� measures over serious and effective economic stimulus or serious immigration reform.
ACTION NEEDED
1. Call Speaker Nancy Pelosi (head of Democratic Leadership) at 202-225-0100.
2. Call Chairman Obey (chair of the House Appropriations committee) at 202-225-3365.
3. Call Democrats who sit on the appropriations committee if you live in their state.
4. Tell them:
� You are extremely disappointed that the E-Verify requirement was included on the Stimulus and you want the provision stripped from the bill.
� Including E-verify in the stimulus package completely undercuts the purpose of the bill and will only be counterproductive for American business, workers and the economy.
� Real solutions to our economic problems and immigration reform should be approached seriously and separately.
� The flawed E-Verify program�s database errors will wrongly workers their jobs.
FAIR (the Federation for American Immigration Reform) just sent out an alert to its very active network to call committee members in support of this provision. We need to counter their calls.

One a 485 is applied and is pending, it is possible to replace the underlying 140, even if it is from a different employer.
Reasons why one would do this -
1. Moved away from sponsored employer within 180 days and a job offer from this employer is no longer available
2. Job Role changed significantly enough to warrant a new Labor.
3. AN old Labor with an earlier PD suddenly got approved. Get a 140 approved for this Labor and replace the earlier 140 with this one.
4. Upgrade from eb3 to eb2.
Reasons why one would do this -
1. Moved away from sponsored employer within 180 days and a job offer from this employer is no longer available
2. Job Role changed significantly enough to warrant a new Labor.
3. AN old Labor with an earlier PD suddenly got approved. Get a 140 approved for this Labor and replace the earlier 140 with this one.
