It's up to the employer if he wants to keep you as an employee and has the right to cancel your H1 if he likes to do so. Just because you left the country doesnt mean that your H1 becomes invalid, but again its up to the employer.

Yes you can apply for H-1 stamping anytime. It has nothing to do with AP.

If anyone is planning to drive from CT for the rally or is not driving because they are unsure, or not motivated enough... then here is your chance.
We can join together and go to DC and come back together. I am planning to go on Monday 17th morning. Ill be coming from New Haven/Hamden area in CT.
If anyone is planning to go in the evening, we have a BUS service available also. We are starting 6:30 PM from Woburn, MA on the 17th and should be reaching Hartford at around 8:15 - 8:30 PM, New Haven at about 9:00 - 9:15 PM.

Also if you are on highways 84 and 91, let us know, as we can pick you up on the way.

Get a copy of your I-140 approval notice. You should be ok. If you apply for a new job, you can apply for 3 years extensions as well as your priority date is portable.
If you are anxious, just pay $1000 and get premimum processing of H1 in the current job.

I believe NameCheck must have been initiated. As far as processing 485 is concerned, does the PD have to be current?

Once every check is completed it goes into a queue and then every month a list goes to an officer based on the priority date and visa availability
The best thing is to call them as soon as the processing dates go past your application date. Call them to find out about ur case. At that time they are open about ur case. They will let you know exactly if your name check is cleared.
They also mentioned that once everything is in place the files goes to the office and then it might take up to 90 days for the officer to make a decision.

- the student is not working/volunteering (peer discussion/helping other students may be ok) for that employer before work authorization.

One comforting factor here is the extra $1000 is big money for no extra work which is very tempting to USCIS. So everyone knew they would bring it back as soon as the load became manageable, but the big question was when would the load become manageable.

That was taken last October on the Island of Dominica at a place called Emerald Pool (believed to be the "fountain of youth" by the locals). The girl in the pic is my girlfriend's sister and didn't mind playing model for me. :)
I'll try to find a color shot of the pool and waterfall for you. Very nice place, buried in the rain forest.

I had Mar 05 PD through RIR but lost it as i never applied for I140. 4 other guys from my company are in the same boat as mine...
Current PD is Oct 05 through PERM...
By the way i dont think we can ever find the count between Jan 05 - Mar 05 through this thread...Data from FOIA request would be more helpful

Suppose I am employed in H-1b with employer �X� for position �A�. Employer �X� filed my Labor Certification and I-140 for a future position �B� and got both approved. Position �A� and position �B� have at least 50% different job duties.
I file my I-485 and it is pending for more than 180 days. I get a better offer from employer �Y�. Now, I want to transfer my H1-B to employer �Y� using AC21 portability rule. My job description with employer �Y� should be similar to position �A� or position �B�?

One way to deal with the maintenance ugliness, would be to cover it with a foreground object. That way it would feel like the whole bridge was in the picture. Just a thought, not sure how it would turn out.
